The domain name www.bombaycollective.com (hereinafter referred to as the ‘website’ ‘The Company’, ‘We’, ‘Us’ or ‘Our’) is owned by Bombay Collective, a sole proprietary concern of Ms. Dhriti Jain, having its principal place of business at Kemps Corner, Mumbai (hereinafter referred to as ‘Bombay Collective’).

While we strive to use commercially acceptable means to protect Your data, We cannot guarantee its absolute security. Bombay Collective assumes no liability or responsibility for disclosure of the user’s information due to errors in transmission, unauthorised third-party access, or other causes beyond our control. The User plays an important role in keeping its information secure. The User should not share its account information with anyone. If we receive instructions through the User’s account, we will consider that such user has authorised the instructions. Notwithstanding anything contained in the Privacy Policy or elsewhere, we shall not be held responsible for any loss, damage or misuse of the User’s Personally Identifiable Information, if such loss, damage or misuse is attributable to a Force Majeure Event.
06. Data Retention
When browsing our website or place an order through the site, we will maintain your information for our records. The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our service, or we are legally obligated to retain this data for longer time periods. Upon request by the User, Bombay Collective will remove / block the User’s Personally Identifiable Information, in turn cancelling the User’s registration. However, the User’s information may remain stored in backups even after the deletion or the termination of the User’s account because it is not possible to delete a single user’s data on backups.

08. Ecommerce Transactions
Those who engage in transactions with Bombay Collective – by purchasing our offerings may be asked to provide additional information, including as necessary the personal and financial information required to process those transactions. We ask for your credit card and billing address so we can charge you for the product or service, calculate taxes due, and send you invoices. In each case, Bombay Collective collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Bombay Collective. Your credit card is passed directly to our payment processor, CCAvenue and PayU and doesn’t ever go through our servers. We store a record of the payment transaction, including the last 4 digits of the credit card number, for account history, invoicing, and billing support. We store your billing address to calculate any sales tax due if any, to detect fraudulent credit card transactions, and to print on your invoices. Bombay Collective does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Bombay Collective may collect statistics about the behaviour of visitors to its websites. For instance, Bombay Collective may reveal how many times a particular offerings of Bombay Collective was downloaded or purchased. However, we will not reveal any personally identifying information unless we have approvals from you.

Our offerings does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and you are aware that your child has provided us with personal data, please contact us.
The Users are hereby informed that in accordance with Rule 5 of the Information Technology (Intermediary Guidelines) Rules, 2011, in case of any non-compliance with the Terms of Use and the Privacy Policy, Bombay Collective reserves it’s right to immediately terminate access or usage rights of the Users. The law governing the Terms shall be the substantive laws of the Republic of India, without giving effect to the conflicts of law principles of any jurisdiction.
11. Governing Law
Any dispute arising out of or in connection with the Terms and / or the licence, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the Mumbai Centre for International Arbitration (‘MCIA Rules’), which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Mumbai, India. The Tribunal shall consist of one arbitrator, selected from the panel of arbitrators with technical experience in the field of information technology by Networking Now India. The language of the arbitration shall be English. The law governing this arbitration agreement shall be the Arbitration and Conciliation Act, 1996 (as amended and re-enacted at the relevant time).
